Asher Takes His Power Back Part 1

On the 19th January, Asher received notice of a formal warning from the GMC regarding two tweets he penned in 2022. He was accused of reverse racism/transphobia/homophobia. This is the conclusion of a 2 year investigation into his social media content that has had a number of devastating effects. We need to trust that the people who have power over us. Are going to do right by us. And I guess.

Therefore how important it is to take your power back because we deserve that power. We do not we did not have to live in a society where some people, a select group of people have all the power and we have none.

And we can stand up. To these rules. So Yeah, this is my version of taking your power back and kudos to Nicola Salmond who was talking to me about the GMC, speaking speaking to her, I've been speaking to her for a while about what the GMC has been doing with me.

And she's the one that pointed out to me. The other day, when we were talking about it, she said, well, what are you going to do to take your PAL back?

And, she did it in a very tongue-in-cheek way and like, see what I did there?

Yeah, very clever, but very true. Hi, Gonna practice what I preach, right? I get a do, what I'm teaching others to do.

So this is my way of taking my power back. One of the things. That happens when you feel this empowered is that you you know you you live in a shame right you you hide your story from other people.

Because you're so ashamed of it. I have no reason to feel ashamed, so I'm done hiding my story.

I want to make it very clear that I'm going to be talking about the whole process what I've been through over the last couple of years.

I'm telling the story because it's my story. These complaints were written against me. I have the right to discuss them by law, but also I think it's really important to understand.

What, you know, the power that certain individuals hold over us and the systems that are in place to allow these people to wield their power over us.

So, full disclaimer, I am not doing this. I'm doing this in and you know making sure everyone's anonymized and I'm not doing this to get back at people.

I'm doing this to tell my story and I have every right to do that because this is my podcast and it's my life and no one can stop me.

I'm sharing my story. So here we go. I think I have to start at the end actually, so bear with me a second whilst I go right to the bottom of this. How many pages is it?

22 page document. So, in January I received an email. From the GMC, a man named Gareth who was the complaints.

My complaints, what's he called? Investigation Officer.

Do not alarm me, I hope you are well. Following from, from considerations made by the case examiners, I am closing a letter.

From an assistant registrar, those are the people that make the decisions. The case examiners feel this case can be concluded within warning.

So, let's read the warning. In 2,022 you posted a number of tweets online.

Who of which referred to people's gender? Color and sexual orientation. In a manner that was, A.

Inappropriate and or . Offensive and or see disparaging. And D, demonstrative, demonstrative of attitudes that were contrary to those required of doctors by good.

Medical practice. This conduct does not meet. With the record, the standards required of a doctor. It risks bringing the profession into disreputes.

And it must not be repeated. The required standards are set out in good medical practice that's them.

Like all the guidelines right it's basically a set of I don't know it's about 62 I can't remember how many is paragraphs, guidelines that we as all doctors must abide by.

In the UK. So good medical practice and a associated guidance. In this case, paragraph 65 of good medical practice and paragraph 5 of the guidance.

The Doctors use of social media, 2,013. Are particularly relevant from good medical practice 65 you must make sure that your conduct just 65 you must make sure that your conduct justifies your patient's trust in you and the public's trust, justifies your patient's trust in you and the public's trust in the profession.

Remember that one. And doctors use of social media number 5 the standard expected of doctors do not change because they're communicating through social media rather than face-to-face or through other traditional media.

However, the Using social media creates a new circumstances in which the established principles apply. Whilst this failing in it failing in itself is not so serious as to require any restrictions on your registration, It is necessary in response to issue this formal warning.

2 warrants such a formal and you know like slap on the wrist I mean You apparently posted Weeats in 2,022 and 2 of them, 2 of them specifically.

Referred to gender. Color and it is color, not race, color. And sexual orientation in a manner that was inappropriate offensive, order spent and offensive and or disparaging.

And the. Of acids that are contrary to those required of doctors. But good medical practice. What the fuck did I do?

You might be wondering, well. And I'll take you back and I'm going to do this chronologically.

In on the nineteenth of April, 2,022 the GMC received a complaint about me.

We are contact you to raise a concern regarding lack of professionalism by a registered medical professional, Doctor Asha in brackets, Natasha, because that is my registered name still folks.

Alarm me, GMC number 6, 7, 7, 5, 6, 7. Involving persistent, targeted, abusive and disrespectful behavior on social media and sharing of medical misinformation.

Related to and I'm sorry but I'm reading it out so obesity. It's a really long letter, folks.

I've never heard of it before. It's apparently a YouTuber that's made a video about me.

And this person Now this person who complained against me about how, you know, I'm professional I am.

Is using that and is it Tattle? At all. Tattle at all life. Yes, Tasal Life is that's that website for those who don't know where people can just basically Go off on anyone and just write whatever they want.

It's completely and utterly, you know, just whoever you want. And neither of those I think are particularly I don't know how should we put this.

Professional? Or meet any professional standards and yet this person who is complaining about my professionalism felt that these kind of stories about me online, you know, the Daily Mail articles that were written about me, those kind of things that warrant investigation by the GMC.

So you know, you make off of you will what you will of that. I'm gonna go on, sorry.

So. Long complaint then on the third year of April another email with more tweets, copies of more tweets.

Targeted and abuse, targeted, persistent targeted abuse and unprofessional behavior. More tweets, here's more tweets, here's what every single tweet was written down.

So the GMC has copies of all my tweets, right? Remember they are punishing me for 2 of them but there are at 1 point time I think there's over 100 pages of tweets.

So. Yeah, then we're more than 2. Let's put it that way. Then on the tenth of May On the ninth of May another follow up email with more tweets the tenth of May another follow-up email with more tweets.

You know during the the month of April and early May. Mid-, to early May, this particular complainant had a lot to say about me and if you were following me around that time you might know why you might have heard the story and you might know why it was going on.

They had said that they wanted a I want to miss. Rebu all of my tweets otherwise they would report me to the GMC and I'd said, no, report me.

That's fine. I'm not removing my tweets. And in each and every one of these, come, well not each and every one of them, but many of the complaints as I said in many of the complaints as I said in many of the emails, there's a seven-page discussion forum about Dr.

Right then. So on the 20 third of May the GMC responded. To the complainant and wrote.

Thank you for taking the time to contact the GMC with your concerns. Regarding Dr. Larmi.

Your concerns were referred to the fitness to practice directorate. Where they were reviewed by an assistant registrar.

We understand you have concerns about Dr. Lamy and the comments and interactions they have made on social media which you found inflammatory, derogatory.

And with the potential of bringing the profession into disrepute and damaging public confidence. An assistant registrar and a senior decision maker has very carefully considered your complaint and while we in no way condone or support their comments they would not require us to take formal actions against them and a way they can work as a doctor at this time.

An investigation can only be opened if the concerns raised are so serious that the doctors fitness to practice medicine is called into question to such an extent.

Action may be required to stop or restrict the way in which they can work. To protect future patients. While the doctors comments and behaviour are in no way condoned.

We do not feel it indicates the doctor indicates the doctor's witness practice is impaired. Or that patient safety is at risk.

By them remaining on the register. Although we are not opening an investigation at present, we do feel it's important that your concerns are shared with the doctors responsible officer so that's basically the person who decides whether or not I can have my license re-validated every 5 years.

So they will be shared with the doctors responsible officer. This will allow the mass to be discussed at their next appraisal or a validation meeting.

We have one of those a year again all counts to whether or not I can hold a license to practice but it's not.

Mean they can't take away my licence it's whether or not I can be re-validated.

And so I can renew my license for another 5 years. They will also be able to remind the doctor of DMC guidance in particular doctors use of social media and of the requirement of doctors to act with honesty and integrity.

To justify the public's trust in them. If the responsible officer has any further concerns about the doctor that require a consideration they can be referred to us in line with the procedures.

I have been having my regular meetings. I've never had any concerns raised about me during my appraisals.

So. There resistant registrar is mindful that doctors are entitled to have their own views and to express these even when they contradict the views of others.

Hartney, I'm allowed to have the point of view, isn't that amazing? We appreciate the public comments made by the doctors by doctors have the capacity to influence and affect.

Others and why you have contacted the GMC. However, they do not feel a formal investigation is required at present.

We acknowledge the views provided and that the doctor refutes some suggestions about obesity and related illnesses, which is generally considered misleading.

We are not advised that the doctor has provided intentionally unsupported knowingly false advice. Dr.

Lamy also cites clinical evidence and findings to support certain views in their posts. It would not be the role of the GMC.

To check the veracity of the evidence. And we would not become involved in scientific debate. We do however fully understand that differences and opinions will arise between colleagues.

The role of the GMC is directly linked to the registration of doctors. Our responsibilities are connected to keeping them medical register.

We oversee medical education. We give entry to the register for those suitably qualified. We advise on good medical practice well registered and we remove or restrict registration in response to fitness to practice concerns where there may be maybe a risk to patient safety.

An investigation can only be opened if the concerns raised are so serious that the doctors fitness to practice medicine is calling to question to such an extent that action may be required to stop or restrict the way in which they can.

Work to protect patients. We do not have legal powers to intervene or resolve matters. 4 complainants.

We appreciate that Dr. Lamy has expressed their opinions about contentious matters publicly. We recognize why this has caused concern.

However, we have not identified specific information that suggests that they have done so recklessly or with intent to cause harm to patients.

We have no suggestion that Dr. Lami is giving direct advice to specific patients that would be detrimental to their individual health.

Having reviewed the concerns raised and the information available, we have not identified serious concerns about Doctor Lamy.

And therefore the allegation that the doctor has posted a medical misinformation will not be taken further. At present.

We have also read Dr. L's. Patreon post where they share your email. Let's not go into all of this.

As a regulator the GMC are unable to intervene to prevent Dr. Larry posting comments about other social media users.

We do not condone reports of bullying and we expect doctors to conduct themselves in accordance with our guidance at all times.

But in line with our regulatory functions, the assistant, is of the view that to consider altering or removing the doctor's registration would not be warranted on this occasion.

We feel that you and your colleagues may wish to seek legal advice on the reference defamation posts.

You know, and this would not be an area the GMC can comment on. And so on and so forth.

So that was the response as you can tell the case was closed. I was still, I still got in trouble, I still, you know, got a formal letter.

But the letter just said we've done an investigation, we've decided not to take it further at this time, please discuss with your response officer.

And that was the end of it. There was no further response to that in November, 2,022.

So this was April, the 22 May 22. In November 22, a review was requested.

In relation to another complaint which I will go into shortly. To determine whether this initial response was materially flawed.

So, basically, if when you complain to the GMC and the GMC do a review, they make a decision and you have the right.

To say no, I disagree with that decision. I want you to take the case further. Now this complainant didn't do that.

But another complainant which I will talk about in a moment did and as a result the GMC decided to review this case as well.

I can't tell you why because there's no explanation, but they decided that even though this complainant had not gotten back to them had not say no I insist that you review this they decided to review it anyway in event.

And they made a decision in November, the 22. That the triage closure decision, which was the original decision I read out to you.

In respect of Dr. Larry, may be materially flawed under Rule 12 and a review is necessary in the public.

A review may be necessary in the public interest. And so. It went further.

And as a result, they believed that they were, that that comment was racist. And discriminatory on the ground of sex and sexual orientation.

That's, I'm gonna leave that bit there. I'm gonna talk about the second complaint now.

The second complaint came in May, 2022. So it was soon after the first complaint. I obviously pissed off a lot of people in that time at the time.

I'm gonna read only a few sections of this. As I said, you can read them for yourself.

I'm read a few sections of them because I need you to hear. The way that this particular complainant describes me, in particular pay attention to the language around my gender.

Having been banned previously banned on Instagram for abuse, Not true, and returned under for abuse, comma, returned under an assumed name, assumed name.

Asha Lami or Lammy Designated. He, him, they. Also known on social media is that doctor, I must refer to Dr.

Lao Mi in a non gendered form in this account. And the title of the email is Got some Tatalami, general practitioner practising and hitching hearts I've never practised in Hitchin Hearts by the way so don't don't take that seriously.

General practitioner designated in quotation marks, she dash her slash her. So these are just the first couple of sentences and you can already tell there are some issues with language, right?

So throughout the so Let's have a look at what. She says about me, this complainant says about me.

So she refers to me as She, he, she slash he? She refers to me.

Yeah, so she, Sometimes they. In this particular letter. She also says I have attached a long communication from I'm not giving their name, a vulnerable blogger who received threats personally from Dr.

Lami that she slash he would be away might harm him. Dr. Lamy knew that this man had a history of abuse and was vulnerable.

He contacted me by email in a state I assessed as suicidal. He has written a report for the GMC.

His statement is attached. Now I am not going to speak too much about this particular individual. I will say 3 things about him.

Number one. This individual was as a cisgender white heterosexual. No, that's not true.

Cisgender white male. Who a thin cisgender white male who has a lot more privilege than I do, right?

And a lot of a lot of supportive people around him, a lot of supportive people on social media who came after me.

And that's the first thing you need to know about him. The second thing you need to know about him is I did not make threats.

I was getting very upset by the way he was speaking to me and I did say stop it otherwise I'm gonna publish these messages but I never did.

He on the other hand did. He published every single one of our personal messages. So I threatened him but he actually not only threatened me but went ahead and did the very thing that he's accusing you of threatening him off.

And the third thing you need to know about this man is in his complaint he sent in some very personal messages from WhatsApp that we've been sharing.

That involved sexual assault. My story. He shared those personal intimate details. With the GMC.
